Saving the planet – Microsoft and Brookfield

Earlier this month, Microsoft and Brookfield Renewables agreed the “largest ever corporate renewable energy deal”, as described by both companies: a 5-year power purchase agreement (PPA) that will support the construction of 10.5 GW of new clean energy in the US and Europe. This deal is a key component in Microsoft’s “100/100/0” clean energy goal: having 100% of its electricity consumption, 100% of the time, matched by clean energy supplies, by the year 2030.

However, let us ask the following questions:

  1. What price is Microsoft paying for its electricity under this deal – and how does this price compare with the current forward price in the relevant wholesale market? (“Relevant” because this question may be asked separately in each jurisdiction.)

  2. If Microsoft is getting a good price (or set of good prices, one in each relevant market), does that not mean that the new renewable energy is competitive – and hence would probably be developed anyway?

  3. What government-backed support mechanisms are available to the new projects in the deal (e.g. support under the Inflation Reduction Act in the US, Contracts for Difference in the UK and Ireland, Germany’s renewable energy levy, etc.)? Apart from financial support, there may be support in terms of planning permission, relevant permits, etc. Can Microsoft produce a table ranking the countries involved in terms of the level of government subsidy paid to Microsoft?

  4. If public support for the new projects is available, would it not be reasonable to attribute some of the reduction in emissions (vis-à-vis normal grid supplies) to the general public rather than all of it to the offtaker – in this case Microsoft?

  5. What is the increase in electricity consumption by Microsoft associated with this deal?

  6. What would be the measured increase in carbon emissions, associated with this electricity consumption, if only a fraction of the new clean energy is attributed to Microsoft and the remainder is socialised, pursuant to Q4? Or if none of it is attributed to Microsoft, pursuant to Q2?

  7. How might the answers to questions 5 and 6 affect the measurement of progress towards Microsoft’s 100/100/0 goal?

  8. What emissions are associated with the new infrastructure and hardware (e.g. data centres, cables, hardware) that Microsoft may construct in relation to the power supplies in this new deal?

  9. If these embodied emissions are also taken into account, how does the measurement of progress compare with the 100/100/0 goal?

  10. What efforts are being made to reduce Microsoft’s demand for electricity? Can these efforts be quantified – including, specifically, efforts to make Microsoft’s AI algorithms as efficient as possible so that they are using the least amount of server energy?

Perhaps Microsoft (or Brookfield) has good answers to these questions. If so, we should hear them.

Has Online Safety gone Offline?

So soon after receiving Royal Assent on 26 Oct 2023 it is worth asking if the Online Safety Act (OSA) has run out of steam and so effectively gone offline.

On BBC TV on 5 May 2024 the parents of children lost to suicide induced by online material challenged Ofcom that they had been sidelined in over-complex and over-sized consultations on Illegal Harms.

It will be a year before the OSA Codes of Practice are published and the Statutory Effect comes into play. It must feel to some as if the Online Safety Act is still offline.

The Online Realm which operates on the Internet, is like a large algorithmic machine, an industrial revolution in its own right. Like all machines made by human hand, it does a great deal of good and, sadly, a great deal of harm. At the moment it seems like the harm is greater than the good, and some of the public are not happy about government responses. Public discontent is currently aimed at many situations besides online safety.

The infected Blood Scandal 40 years after issues were notified to authorities is resulting in £210,000 payouts with more to come; which won’t help the 3000 who died. Then there is the Post Office Horizon Scandal with issues starting 35 years ago and despite many lives destroyed or lost, financial payouts are yet to be awarded by government.

How similar these backgrounds are – a small issue that if attended to could have prevented a significant safety failing. Instead, those with the knowledge and power spent decades of time and effort in preventing the bad outcome being found and worked on. Which raises the question: will online safety be the next disaster in 10 years time where it is found that something that could have been done now, wasn’t, AND that instead of using public funds to make things work, our money was used against us to ensure that the bad things that had happened, were prevented from proper scrutiny and allowed to get worse?

The original Industrial Revolution started in Great Britain in 1731 was also a source of good which had bad outcomes. It took until 1974 for significant safety law to be created (Health & Safety At Work etc Act 1974) but only after the Aberfan coal disaster killed 116 children and 28 adults. Even now after 50 years of this law, safety in the workplace is far from guaranteed, with some playing Russian Roulette with people’s lives.

The Tech Companies are the modern day equivalent of 1731, overseeing the Information Factories of the world. The only difference is that most of us are inside those factories not outside, often unwittingly within a whisker of being mangled in those algorithmic machines.

Regulators like Ofcom have always had a tough time, on behalf of the public, to obtain some order and protection from things going wrong. Up until now it was accepted that regulators would have to play catch-up with issues. The modern regulator of the online realm does not have that luxury of time because the level of harm generation already far exceeds what was thought possible. Traditional approaches to safety involve an attempt to stifle the production of failure. This has not worked. Safety in the online realm demands a new strategy: a strategy designed to amplify the potential good, such that the potential for harm is stifled by the success of the good.

As Ofcom have said: tech companies have had the opportunity to self-regulate, and the lack of good outcomes means that the online realm needs to be regulated. However, regulation in the traditional way has always provided the opportunity for profit to be put above safety. The online realm is a multi-billion dollar industry which means plenty of money is available to fend off perceived challenges to profit by safety concerns. The message that has not yet struck home in any industry is that Profit and Safety CAN co-exist if we find ways to make that happen.

As the Online Harm Genie is out of the bottle and gone offline, we need a regulator with this never-seen-before way of thinking about safety; for all our sakes. Else the algorithmic machines will chew us all up and there will be nothing left of us. There is no need for this tragic outcome. All of us need to help our online safety regulators create green and pleasant online realms for us.

JAAG supports initiative to teach ethical AI

The Lord Mayor of London, Professor Alderman Michael Mainelli, has been working with CISI, the Chartered Institute for Securities and Investments, and BCS, the Chartered Institute for IT to provide courses that lead to certificates in the ethical development and deployment of AI in the financial sector.

The aim is for these courses to act as standards that will support ethical AI practice within the City of London and beyond.

As noted by Dr Brian Ball, AI and Information Ethics Research Lead at Northeastern University London, “The introduction of these certificates constitutes an important step towards putting ethical AI into practice”, adding that “ethical practice requires an ecosystem of support” that also includes legal regulation and corporate governance.

JAAG is proud to contribute to this initiative by working alongside other experts to develop course materials, drawing upon JAAG’s expertise in the ethics of AI. We are also participating in the Lord Mayor’s Ethical AI Steering Group and the Academic Sub-group.

JAAG believes this initiative is a great opportunity for computing professionals to get vital ethics training.

Minister urged to make Government AI transparent

JAAG has joined with the Public Law Project and many other civil society organisations to urge the Government to make major changes to the Data Protection and Digital Information Bill, currently being debated in the House of Lords.

Government should be under a legal duty to be upfront about when it uses AI to make decisions that affect people’s lives – such as in education, health or welfare – according to a group of over 30 civil society organisations, academics, legal professionals, think tanks and unions.

As Government uses AI and algorithms to make more and more decisions that affect people’s daily lives, from A-levels to Universal Credit, the group has asked Secretary of State for Science, Innovation and Technology Michelle Donelan to amend the Data Protection and Digital Information Bill currently in the House of Lords. 

A change in the law is urgently needed if Government wants to build public trust in how it uses technology and avoid catastrophes such as the Australian Robodebt and Dutch welfare scandals that harmed tens of thousands of people.  

Shameem Ahmad, CEO of the Public Law Project said:  

“Any decision-making system, AI or human, will at some point go wrong and treat someone unfairly; whether that affects their A-level results, the time they must wait for an organ transplant or their access to vital welfare payments. The difference at the moment is that public bodies can get away with using automated tools in the shadows. Without transparency, there can be no accountability or trust in the systems that govern us. 

“If Government is serious about using this technology for the good of everyone, it must urgently make sure public sector AI use is transparent. Knowing how automated decisions are being made is the first step in seeking redress and putting things right if they go wrong. 

 “AI has great potential, but scandals in Australia and the Netherlands show that these systems can make incorrect decisions at speed, inflicting great harm on a huge number of individuals. Given the stakes, government must take this opportunity and act now.” 

The letter says: ‘The speed and volume of decision-making that new technologies will deliver is unprecedented. Their introduction creates the potential for decisions to be made more efficiently and at lower costs. However, if the use of these systems is opaque, they cannot be properly scrutinised and those operating them cannot be held accountable.’ 

How transparent is Government about how it uses AI? 

  • Public bodies can voluntarily publish information on how they use algorithms under the Algorithm Transparency Recording Standard (ATRS) which was created in 2021.  

  • Since its inception, only 7 transparency reports have been released. 

  • Many of the key government departments using tools that fall within the scope of the ATRS, such as the Home Office and Department for Work and Pensions, have never submitted a report. 

  • The Tracking Automated Government register was launched in 2023 by the Public Law Project. It currently lists 55 automated tools used by public authorities. The TAG register was not built by government; it was pieced together by Public Law Project from information, hard-won through investigations by journalists, civil society organisations and academics.  

Recent changes to the ATRS don’t go far enough

As part of the Government’s response to its AI regulation White Paper consultation, it announced that the ATRS will become a ‘requirement’ for government departments using algorithmic and automated tools, but this requirement will not be on a statutory footing; it will be in guidance only. 

The letter to Secretary of State Michelle Donelan says an explicit legal obligation is needed: 

‘Such a duty is proportionate to the nature and impact of the risk posed by the widespread and fast-growing use of AI and algorithmic tools and will ensure that public authorities can be held accountable for failure to comply with the duty.’

AI perpetuates racial stereotypes

Recent research has shown that generative artificial intelligence (GAI), repeats and replicates racial stereotypes.

Many health organisations are already using AI-generated imagery to illustrate publications. But those images may well perpetuate bias and stereotypes such as the so-called ‘suffering subject’ and ‘white saviour’. Arsenii Alenichevand colleagues asked the Midjourney Bot to generate images showing (for example) Black African doctors caring for sick White people. It could not do it. The AI program: 

  • Could not show Black African doctors providing care for White suffering children – the recipients of care were always rendered Black;

  • Rendered doctors as White, even when asked to show Black doctors, sometimes even rendering the ‘doctors’ as White men dressed in exotic ‘Black African’ clothing;

  • Even when asked to show a traditional African healer healing a White child, the ‘White child’ was shown wearing ‘a caricature of broadly defined African clothing’;

  • When asked to show doctors helping children in Africa, the program provided pictures of doctors and patients with ‘exaggerated and culturally offensive African elements such as wildlife’; and

  • Portrayed all people with HIV as Black.

The researchers conclude that, although the AI developers say they are committed to providing non-abusive pictures of people and cultures, they in fact create images representing ‘white saviour and Black suffering tropes and gendered stereotypes’.

The research again underlines that racism, sexism, and coloniality are embedded in AI. This is in part because AI learns by absorbing existing images available online, and does so even if the images are disrespectful or abusive to people or groups.

Ethical dilemmas posed by Artificial Intelligence

Long term worries about the impact of AI are being raised in the media. Yuval Noah Harari warns, for example, about the creation of a completely new culture (because AI can create new cultural artefacts), fake intimacy and the destruction of democracy.[ii] Ex-Google chief Dr Geoffrey Hinton left his job[iii] due to concerns about bad actors and existential risks due to things more intelligent than us taking control. The head of OpenAI, who developed GPT, is raising alarm more widely about the potential impacts of AI and calling for regulation.[iv]

Hype

It could be argued that most Big Tech leaders and AI developers say they’re aware of the risks associated with AI. For example, in March 2023, the Future of Life Institute published a letter[v] –signed by 30,000 people including Elon Musk[vi] [vii], Steve Wozniak (Apple co-founder), Dr Geoffrey Hinton (ex-Google AI expert) and Yuval Noah Harari (academic historian and bestselling author). They call on major AI developers to agree on a six-month pause of any systems more powerful than GPT-4 [viii] and to use that time to develop a framework for ensuring safety; or, failing that, for governments to step in with a moratorium. The letter referred to the risks of AI-generated propaganda, loss of jobs, human obsolescence, and society-wide loss of control.

So we might assume that Big Tech leaders and AI developers will make sure nothing goes wrong.

In fact, the situation is complex and nuanced. Many Big Tech leaders do indeed stress the danger of anthropomorphic machines taking control and destroying civilisational; but this can be seen as AI hype designed to mask – and take attention away from – the very real problems that people are experiencing here and now from automated systems.

Ethical shortcomings of AI systems

The (non-)ethical behaviour of AI-assisted machines has been in the news not only from AI developers raising the alarm but also due to problematic cases that have come to light, such as bias in judicial decision-making[ix], bias in recruitment[x], chatbots that started to use racist language[xi], etc. Companies like Amazon are taking control of their customers’ (and other people’s) data and using it. More fundamental questions have been asked about whether any AI could ever be trusted with decisions that impact human life.[xii] [xiii] [xiv]

So, the rapid development of AI systems brings with it hitherto unthought-of ethical dilemmas.

It might technically be possible to overcome some of these if we code some of our ethical values into some of the AI systems and hope it alters their behaviour as we would wish. We could perhaps think of an evolutionary process allowing some ethical-like behaviour to emerge under favourable conditions, or to favour machines that might want to continue to exist, or it might happen that a machine could develop (from some kind of a reward system) a new sub-goal related to itself continuing to exist. But this might sometimes contradict what might be in the best interests for humans. The ethical problem remains.

An AI ethical vacuum

AI may be deployed in ways that involve privacy and security breaches, discriminatory outcomes and an adverse impact on human autonomy. For example, training data for AI systems may be obtained via unauthorised means: not only is there a privacy issue, but creative rights can be exploited. There are currently legal challenges to OpenAI about the way that it obtains and uses other people’s intellectual property. There are also issues with the truth of the outputs of the system: not only do algorithms replicate the biases of the training data, but there are issues concerning falsehoods being replicated and difficult to correct.

A central problem with large language models like ChatGPT is that humans can treat these systems as some kind of Oracle and mistake the system’s output for meaningful text and act accordingly. Information given may not be true and reputations may be ruined. Relevant actors within the environment in which the AI is embedded should anticipate and take account of the social impacts of technology post deployment but unfortunately this is often not done in a timely way: consideration should be given to job disruption, social justice, sustainability, and the effects on vulnerable groups, among other aspects. Many local councils in UK have had to abandon the use of facial recognition systems because of ethical and legal issues.

The way in which issues with algorithms within automated systems are dealt with, whether AI systems or other types of automated system, can be paramount in the avoidance (or otherwise) of harm.  For example, there is an ongoing miscarriage of justice that is currently in the news in which hundreds of sub-postmasters in the UK were wrongfully prosecuted for theft, false accounting and/or fraud. In 1996, International Computers Limited (ICL) began working on a computer accounting system, called Horizon, for the Post Office and the UK government. By 1999, ICL was part of Fujitsu, and Horizon was introduced, however it wrongly detected the existence of financial discrepancies at multiple post office branches. Investigations and legal cases have been held, with some compensation given, but the matter is still not completely resolved. Meanwhile, many hundreds of the sub-postmasters’ lives have been very adversely affected.

In June 2020, four working single mothers successfully defeated a court appeal by the Department of Work and Pensions following considerable hardship to them due to loss of Universal Credit income arising from a design failure (related to pay date clashes) within the automated system used in Universal Credit and the refusal to fix this.

Also in 2020, the exam regulator Ofqual downgraded almost 40% of the A-level grades assessed by teachers, which culminated in a government U-turn and the system being scrapped.

So, what should concern us is not so much the morality of AI but rather about the morality of the companies or other entities that develop and control AI; it is they who need to be obliged to act ethically.

Instead of worrying about imaginary digital minds we should focus on the current exploitative practices of companies that develop AI systems which increase social inequality and centralise power.[xv]

We should be building machines that work for us, not adapting society to the wishes of those few elites currently driving the AI agenda.

Those most impacted by AI systems, who include the most vulnerable in society, should have their opinions taken into account. 

A better approach – ethical AI

It Is vital that governments regulate to protect individuals’ rights and interests, and thereby shape the actions and choices of corporations.

Humans need to reach a shared understanding as far as is possible in a given context, based around social good and ethical standards.

A positive approach to ensuring that AI always operates in line with ethical standards would incorporate several elements. As a start, there would need to be a legal framework ensuring:

  • protection against exploitative working practices

  • strongly enforced ethical guidelines reflecting society’s priorities, and

  • transparency (including being transparent about the fact that AI is being used), so that people know what is going on and are able to make choices accordingly

  • accountability (of developers and deployers) , and  

  • humans in the loop so that the meaning and impact of automated decisions can be assessed and reviewed and it is not just a case of the computer saying ‘no’, particularly where the decision would significantly or adversely affect someone.

But how could this be achieved?

Ethical guidelines

There are different approaches to ethics – rules-based versus outcomes-based – and there are cultural sensitivities to take into account.

AI ethical standards are still quite immature, but there is a plethora of AI ethical guidelines. To quote just one example: ACM[xvi] recently proposed nine principles for responsible algorithmic systems: legitimacy and competency, minimising harm, security and privacy, transparency, interpretability, maintainability, contestability, accountability and limiting environmental impacts.

Ethical ecosystem

For any standards to have effect, they would need to be overseen and enforced. The extent to which the ethical impact of an AI system would be assessed, and the degree of properties such as transparency would need to be consistent with the AI system’s impact and associated public policy.

Good AI governance should be deployed across organisations, with strong oversight.[xvii]

Other types of AI systems, such as those causing exploitation, should just not be developed.

European legislators are finalising a new AI Act with embedded ethical protections; this will not apply to the UK, which is taking a much lighter touch approach to regulation since Brexit. The proposed EU AI Act is designed to “guarantee the safety and fundamental rights of people and businesses, while strengthening AI uptake, investment and innovation across the EU”. It will “provide risk-based, legally binding rules for AI systems that are placed on the market or put into service in the Union”.

Ethical working practices

Ethical design should be employed at all stages of AI development and deployment[xviii]; e.g. in the deployment of AI, any potentially harmful effects should be mitigated, so[xix] if jobs are lost through AI[xx], society would need to set up rewarding activities for those put out of a job, and protect their income.

Conclusion

There is a huge potential for new AI tools that are truly good for humanity, especially in the medical field.  But technology can be used for good or for ill. For example, though phone tapping exists we probably wouldn’t like to do without the telephone; we rely on legislation based on ethical standards to protect us. The same could apply for AI.

It is not just AI that is the problem here. When I recently asked for a definition of AI in chat GPT, I received the result ‘A field of computer science exploring the creation of intelligent machines capable of performing tasks that typically require human intelligence.’
But some issues are in common with a broader category relating to usage of algorithms to make decisions affecting people. In computing, an algorithm is a procedure for producing a defined result (e.g. performing a calculation), as distinct from a specific set of instructions (program) implementing that algorithm.

In JAAG we extend the term to encompass the whole system of procedures and rules followed by people as well as computers for a given purpose. We focus, in particular, on systems by which an individual is judged to merit receiving some kind of benefit, service, or privilege, or of being subject to some kind of charge or penalty. As harm can result from their deployment, even now, we should take care not to narrow down unduly the focus of consideration.

An ethical framework for AI and humanity?

Where does ethics come from? It’s made up by people in a cultural context; there is no standard upon which everyone would agree.

The ethics of decision-making systems is a live topic, and well-funded institutions are already conducting projects in this area.

There is plenty of background information about ethical AI already produced[i], with sets of broadly common principles that include privacy, transparency, accountability, sustainability, etc.

Broadly speaking, these ethical frameworks, designed to influence company behaviour, can be seen as a broadening out of the already existing privacy accountability governance frameworks, although there are additional aspects to be considered such as technical means to address bias.

But there is also currently quite a lot of ‘ethics washing’ going on, especially from large companies trying to water down ethical AI principles and regulation.[ii]

So some ethical frameworks will be more trustworthy than others, depending on an individual’s viewpoint and the background of the people producing them: for example, EU citizens might rate more highly the outputs of the EU ethics expert group influencing the upcoming EU AI Act[iii]

Key elements of an ethical process

In order to devise an ethics for ‘doing the right thing’, with respect to the behaviour of an accountor (such as the developer or deployer of an AI system), criteria need to be specified for judging ‘good’, ‘bad’, ‘right’, etc.  and then the ethical quality of the accountor’s actions needs to be judged according to these criteria, and if there are shortcomings, reasons need to be provided.

A core part of the accountability involved is to determine and clarify the rights and obligations of actors, including clearly allocating privacy and security responsibilities across supply chain actors and other parties involved in providing the service.

It is useful to distinguish between

  • ethics inside AI-based systems,

  • the ethics of businesses or people developing AI-based systems, and

  • the ethics of AI deployments.

Although it is important for all three aspects to be ethical, the ethical problems involved in these three aspects may be solved using different techniques. For instance, the question of ethics inside AI seems more abstract, and current efforts fall short of expectations[iv], especially as the newer types of AI system no longer directly encode heuristics or semantics. On the other hand, the ethics of people developing AI and the ethics of deploying AI in a particular context may be more amenable to being solved using currently available techniques. There are already some techniques that have been recommended to develop AI in an ethical manner. [v] [vi]

The deployment of AI-based systems requires the analysis of development techniques and social contexts, as well as the deploying the organisation’s own practices.

There are different approaches to ethics that may be taken within each of these:

  • rules-based versus outcome- based,

  • virtue ethics and

  • cultural sensitivities to be taken into account.[vii]

For example, Aristotelian human well-being / flourishing could be made central to an ethical approach when developing AI systems (as with IEEE[viii], where associated metrics are also provided).

Ethical decision making

In every aspect of human activity, different ethical approaches can be taken. Broadly speaking, these divide into

  • teleological approaches (an ethics of what is good – for example, utilitarianism) and

  • deontological approaches (an ethics of what is right – for example, using Kant’s categorical imperative).

Depending on which ethical approach is taken, the answer about the right course of action might be different.

  • A teleological decision looks at the rightness or wrongness based on the results or the outcomes of the decision.

  • A deontological decision instead considers the moral obligations and/or duties of the decision maker based on principles and rules of behaviour[ix].

Ethics in business

The ethical dimensions of productive organisations and commercial activities have been studied since the 1970s within the field of business ethics, and a number of different approaches can be taken corresponding to this[x], ranging from Milton Friedman’s view of corporate executives’ responsibility generally being to maximise profits while conforming to basic rules of the society to the opposing idea of corporate social responsibility (actions by businesses that are not legally required and intended to benefit other parties).

In order to use these ethical approaches in a practical perspective by embedding ethics within business operations, one approach is to try alternative approaches and see the extent to which there is agreement. This may sound simple, but actually it is not necessarily an easy process.

Let us consider comparing just one form of deontological judgment with one form of teleological judgment. If the result were that you would be doing the wrong thing and getting the wrong results (poor outcome), it might seem fairly obvious that a project fitting in that category should not go ahead, just as it needs little thought that a project doing the right thing and getting a good outcome is perfectly fine to go ahead. However, if you regularly deliver highly on the deontological spectrum but poorly on the teleological spectrum, you may well go out of business as it just might not be sustainable financially to continue. Conversely, if delivering highly on the teleological spectrum but low on the deontological spectrum, the drive for profit is taking precedence over consideration about what is (or is not) the right thing to do. Also, there is a zone of ethical nuances (especially along the boundaries between these) where the conclusion is not clear. Furthermore, when there is an economic slump, things can be perceived to be ethically questionable that would not have been before, so this ethical nuances zone can change.

Moreover, there tend to be different kinds of ethical perspectives for different types of organisations. For instance, guardian roles (such as regulators) seem to favour a deontological culture, whereas commercial institutions seem to favour a teleological culture and other actors (such as activists and technologists) may favour virtue ethics roles. Broadly speaking, governmental policy makers have outcome-based ethics, like commercial organisations, but are interested in economic and developmental outcomes at the national or regional level rather than the organisational level. Citizens have their own ethical framework.

These different ethical frameworks and potentially conflicting objectives can make designing ethical codes of practice for the configuration and commercial use of new technologies difficult. The code of practice could be a failure if it is unacceptable to any of these types of stakeholder. It must provide adequate protection of individuals’ rights and interests. It must also give guidelines and assist with compliance to laws and regulations, as well as being practical for information technologists to comply with, and allowing new innovative mechanisms to achieve their potential for driving socially and economically beneficial applications. In addition, it is beneficial to take into account a more nuanced understanding of “harm” including risk, potential harm, and forms of harm other than just physical and financial. In the data protection sphere, this is somewhat accounted for within the notion of Data Protection Impact Assessments (DPIAs), which extend the standard practices of security risk analysis to examine also harms to the data subject with regard to a proposed activity. In carrying out this assessment the summation of the harm across society needs to be properly evaluated and justified, as otherwise there is a risk that the potential harm to a single individual, as measured by an organisation that has a particular activity in mind, will typically tend to be overridden by other concerns.

There are different examples of ethical frameworks for decision making in contexts particularly influenced by recent technological development from different countries.

But many initiatives that purport to define principles and frameworks for the ethical development and deployment of AI are not truly independent, being sponsored by corporations.

Whose ethics?

But whose ethics would be used in an AI system?  There is no standard ethical framework universally accepted. Even if different nations or parties were to agree to one, this would not be enforceable and people could have a false sense of security, thinking things were fine. The issue of companies who ultimately control usage of AI and their selfish motives would remain.

How can we account for the subjectivity of ethical judgment? Solutions might include allowing customisation or tailoring, having inputs from the different parties involved or a process protecting the rights and interests of the less powerful (as suggested for algorithmic impact assessment procedures[xi]). Another approach tried was the BCS framework[xii], which was a meta-framework that allowed different ethics approaches to be slotted in, although the realisation of this system was not completed. Discussion amongst affected and involved parties should be part of the process: there are some current promising initiatives such as the Open Data Institute’s [xiii]Ethics Canvas, and others of a similar nature, which provide a framework for stakeholder discussion and information capture.

Some of these aspects and principles are easier to embed into AI systems than others, for example dependent upon the nature of the AI system (rules-based or machine learning (ML), etc.). Virtue ethics may be used as a regulating force as goal-directed behaviour becomes internally set. Techniques influenced by ethical considerations include the provision of flowcharts to encourage developers to think about ethical aspects at appropriate points, the provision of a common vocabulary for different involved parties, the education of developers, giving people impacted a choice and a say, banning certain types of development absolutely, etc.

We should also put in place mechanisms to address in a more ethical way the consequences of AI, such as introducing Universal Basic Income at a decent level, as jobs come more under attack, and making sure that the money to pay for this will come from the people who are benefitting most from the introduction of the new technology.

Substantive Basis for Ethics

How can we provide a substantive basis for ethical judgment? Most ethical frameworks do not provide a substantive basis for ethical judgment but rather a list of values for discussions, and this can prove inadequate in terms of independent assessment of a proposal. Domain by domain, it might be possible to take an analogous approach to that described by Gary Marx for the surveillance domain (as an example of new types of activity around enhanced surveillance possible using new technology)[xiv]; he shows how societal norms can inform an ethics for surveillance. To do this, he asserts that the ethics of a surveillance activity must be judged according to the means, the context and conditions of data collection, and the uses or goals; he suggests 29 questions related to this. The more one can answer these questions in a way that affirms the underlying principle (or a condition supportive of it), the more ethical the proposed activity would be deemed to be. In this case, four conditions are identified that, when breached, are likely to violate an individual’s reasonable expectation of privacy, respect for the dignity of the person is a central factor and emphasis is put on the avoidance of harm, validity, trust, notice, and permission when crossing personal borders.

We need ethical frameworks for AI

Nevertheless, despite these problems, and any framework being potentially some kind of straightjacket that is kicked against, if we want AI to exist in our world then we do need to have principles and frameworks that will try to control its usage, as the alternative is even worse. 

Overall, the recent document produced by the IEEE Global Initiative on Ethics of Autonomous and Intelligent Systems on Ethically Aligned Design provides a very good consideration from a ‘neoclassical’ engineering perspective of how both classical Western and non-Western ethical approaches may be taken into account to benefit AI development and deployment.[xv]

One example solution: Quaker Ethics

As an organisation influenced by (although not centrally tied to) Quaker principles, JAAG considers a good starting point for an ethical framework to be Quaker business ethics[xvi], whose central principles are truth and integrity (including speaking truth to power); justice, equality and community; simplicity; peace; the light within/individual moral compass.

With regard to AI ethics, there are several aspects that should be considered in a given context; these include the truth of the outputs of the system (including replication of bias and ability to detect and correct inaccurate information); social justice and effects on vulnerable groups; sustainability; and not contributing to excessive inequalities of wealth distribution. In addition, certain activities should just not be allowed, including those that threaten peace and community.

Oversight

And who will enforce and judge this properly? Much can happen ‘under the radar’, regulators are typically very under-resourced and there will be some bad (or otherwise-focused) actors not willing to engage at all. Licensing and trust marks issued by trusted third parties which check what is actually happening in the AI black boxes and beyond could be useful. But ultimately who funds and who guards the guardians?

Brent Mittelstadt’s research[xvii] in “ethical AI” has shown that principled self-regulation, via agreed ethical principles, cannot be relied upon to be effective. These findings match our own experience.

Based on long experience with assessing safety-related systems, we are proposing not only standardisation and independent certification but also the use of protections at each relevant stage of a system’s lifecycle.

A future possibility: Automating techniques for ethical checking

It is interesting to speculate how the cause of a problem may also be used to help with its solution. AI-based systems are currently deployed through an exhaustive investigation of physical and digital artefacts by human beings. However, it is well within the realm of possibility that techniques to analyse digital artefacts and draw conclusions about the AI creation and deployment process would soon be available.[xviii]  In our opinion, there will be increasing efforts to automatically identify digital artefacts that could be used to infer ethically problematic practices. Initially, these might be limited to generating reports which are then evaluated by a human. However, as with as automated testing and natural language generation, or theorem proving, computer science has a history of automating small tasks that build on each other to perform a complex operation. This may result in more sophisticated tools that may eventually be able to perform deeper analysis on a company’s artefacts to infer ethical values, just as the ISO 9000 series of certifications allows us to infer product quality from process quality. We would speculate that simpler tasks such as checking whether datasets have been de-biased would be the first milestone in this endeavour, with other practices following suit. Automation thus functions as a marker of human ingenuity, where we are able to dissociate the task from the intelligence required to do it, by breaking it down into simpler objectively evaluated parts.

Palantir win lucrative NHS data contract

The Just Algorithms Action Group (JAAG) is a non-profit group working for greater social justice in Artificial Intelligence and algorithmic systems.

That’s why we are extremely concerned at the government’s plans for a Federated Data Platform (FDP) for NHS health data.

We are worried about the lack of transparency in the government’s proposals. In particular,

  • we’re not convinced that there will be proper consent and safeguards to govern how patients’ data will be used and protected,

  • we think it unwise to lock this valuable data set into a system controlled by a monopoly business, and

  • we believe that the £480m could be more effectively spent on direct patient care.

As if this wasn’t enough, yesterday the government announced that that they have awarded the lucrative contract to run the FDP – the biggest IT contract in the health service’s history – to Palantir, a US company.

It’s already worrying that the intimate health data of millions of UK citizens will be in the control of a company outside the UK.

What’s even more alarming is that Palantir have a track record that doesn’t inspire confidence in their ability to handle sensitive health information ethically. Palantir is known for its work with intelligence and military agencies in the US, UK and elsewhere, such as the CIA.

The firm gained a foothold in the NHS in March 2020 when, at the government’s invitation, it began analysing huge amounts of health service data to help with the official response to the unfolding Covid pandemic’. Palantir charged the government only a nominal £1 fee.

The government say that: “… there will be clear rules and auditability covering who can access this data, what they can see, and what they can do. …. The provider of the software will not … be permitted to access, use or share it for their own purposes”. A separate provider has been given a contract for ‘Privacy Enhancing Technology’, “to enhance the security of data used in the FDP”. An advisory group of health and care stakeholders and patients will help to shape how the FDP is implemented.

However, JAAG shares the concerns expressed by many others about privacy, ethics and human rights:

  • The Doctors’ Association UK is concerned that “Basic issues of informed consent are being ignored, and this deal could lead to a loss of privacy and seriously erode patient trust.”

  • The British Medical Association recently told the then health secretary, Steve Barclay it had serious concerns involving privacy and ethics, about both the FDP and Palantir in particular.

  • In 2020, Amnesty International expressed concern at Palantir’s ‘highly questionable’ human rights record, saying “The UK public have a right to know what sort of company is being granted unprecedented access to their health data records, and precisely what Palantir intends to do with it.”

  • David Davis, the former Brexit secretary, has said that Palantir’s close relationship with the CIA meant that “it is the wrong company to put in charge of our precious data resource. Even if it behaved perfectly, nobody would trust it,” he told the House of Commons.

12 challenges for AI governance – is the UK lagging behind?

A parliamentary report urges the UK government to make a “serious, rapid and effective effort to establish the right governance frameworks” on artificial intelligence (AI)

In August 2023, the UK Parliament’s Science, Innovation and Technology Committee published the interim results of its inquiry into AI. They identified twelve AI challenges that policymakers must address (see below).

MPs want an AI bill to be a priority for ministers, but the government has previously indicated that it does not intend to introduce legislation to regulate AI in the short term. The MPs’ report warns that legislation is needed already in the 2023/24 parliamentary session, because any delay would “risk the UK… falling behind … the European Union and the United States who are pressing ahead with legislation”. A General Election is expected in 2024.

The government should be moving with “greater urgency” said committee chair, Greg Clark, because the UK “is already risking falling behind the pace of development of AI”. MPs fear that “ if the UK does not bring in new statutory regulation for three years it risks … other legislation — like the EU AI Act —becoming the de facto standard.”

Only last month, the independent Ada Lovelace Institute pointed out that, on the one hand, the government wants to position the UK as a global hub for AI safety research but, on the other, is proposing no new laws for AI governance and is actively pushing to deregulate existing data protection rules in a way that is a risk to its AI safety agenda. MPs are concerned at the government’s plans to ask existing regulatory bodies to deal with the twelve AI governance challenges, without giving them any new powers or formal duties.

Twelve challenges for government according to MPs

1.           Bias:
AI can introduce or perpetuate biases that society finds unacceptable.

2.           Privacy
AI can allow individuals to be identified and personal information about them to be used in ways beyond what the public wants.

3.           Misrepresentation
AI can allow the generation of material that deliberately misrepresents someone’s behaviour, opinions or character.

4.           Access to Data:
The most powerful AI needs very large datasets, which are held by few organisations.

5.           Access to Compute:
The development of powerful AI requires significant compute power, access to which is limited to a few organisations.

6.           Black Box:
Some AI models and tools cannot explain why they produce a particular result, which is a challenge to transparency requirements.

7.           Open-Source:
Requiring code to be openly available may promote transparency and innovation; allowing it to be proprietary may concentrate market power but allow more dependable regulation of harms.

8.           Intellectual Property and Copyright:
Some AI models and tools make use of other people’s content: policy must establish the rights of the originators of this content, and these rights must be enforced.

9.           Liability:
If AI models and tools are used by third parties to do harm, policy must establish whether developers or providers of the technology bear any liability for harms done.

10.        Employment:
AI will disrupt the jobs that people do and that are available to be done. Policy makers must anticipate and manage the disruption.

11.        International Coordination:
AI is a global technology, and the development of governance frameworks to regulate its uses must be an international undertaking.

12.        Existential:
Some people think that AI is a major threat to human life. If that is a possibility, governance needs to provide protections for national security.

The JAAG view

JAAG is concerned that, without adequate parliamentary scrutiny and appropriate regulation, people in the UK will continue to be at risk from biased decisions, invasions of privacy, and inadequate redress.

What is more, after Brexit, UK legislation in this area is likely to diverge more and more from that of the EU. As a result, UK citizens are unlikely to enjoy the protection currently afforded by the General Data Protection Regulation (GDPR). Obviously, too, they will not be covered by the forthcoming EU AI Act (not yet enacted in law), which it is planned will (for example) impose strict safeguards on high-risk AI systems and will ban activities such as mass facial recognition surveillance.

This new EU regulation has been developed with the advice of experts, including on the ethics of AI, as well as with the input of civil society and elected representatives. JAAG wants any future UK legislation to be debated and designed in a similar way. The current UK government does not have a good track record of involving civil society in AI discussions (see our earlier blog about this), but it is vital that UK citizens are not exposed to greater risks from AI than their EU counterparts.

Just algorithms: Siani Morris calls for AI regulation

This letter from Siani Morris, one of JAAG’s Directors, was recently published in The Friend magazine.

“Ruth Jones’ suggestion (The Friend, 23 June) that Quaker principles could help inform an ethical artificial intelligence (AI) gives food for thought. Quaker business ethics do have a great deal to offer when considered against current AI systems that make life harder for the weakest in society.

For instance, right now AI algorithms replicate human biases. There are also issues with: falsehoods being replicated (which makes them difficult to correct); creative rights being exploited; and with AI systems not understanding the adverse affects of their decisions on humans. A central problem is that humans mistake AI output for meaningful text, and act accordingly. This is happening right now. Information given by AI language models may not be true, reputations may be ruined, and decisions may be ill-founded – and the basis for those decisions unknown.

Another issue is social justice and the effects of AI on vulnerable groups. We need systems that do not contribute to excessive inequalities of wealth distribution. As Ruth mentions, sustainability is another important aspect. In addition, certain activities should just be forbidden, including those that threaten peace and community.

Visions of anthropomorphic machines causing the destruction of civilisation are common, but these take attention away from the very real problems we already have from the use of AI systems. Exploitative practices, often motivated by desire for power or financial gain, are already increasing social inequality and centralising power.

We need to do more than just hope that AI can gain an ethical consciousness. We need humans inside the AI loop, ethical guidelines that are strongly enforced, and enough transparency that people know what is going on and are able to make choices accordingly.

So, we need to focus on providing this transparency, letting people know when AI is being used, and on the accountability of developers and deployers. We need protection against exploitative working practices. New regulation should protect the rights and interests of people and thereby shape the actions and choices of corporations. We should be building machines that work for the common good, not adapting society to the wishes of those few elites currently driving the AI agenda. Those most impacted by AI systems, which includes the most vulnerable in society, should have their opinions taken into account. (It’s worth noting that many of these problems do not just apply to AI, but also to other digital systems, many already being deployed, including the UK universal credit software.)

But let’s not forget that technology can be used for good or for ill. Phone tapping exists, but that doesn’t mean we want to give up our phones. The same could apply for AI. There is a huge potential for new AI tools that could be truly good for humanity, especially in the medical field. How might Joseph Rowntree, for example, have used AI?”
